FAQ on 43rd District Democrats PAC Closure

How will the 43rd District Democrats continue to operate?

The 43rd District Democrats have not participated in traditional PAC activities in many years, such as donating money to candidates or running a separate campaign for candidates. The only change for our members is that we will no longer print a sample ballot. We will continue working to elect Democrats up and down the ballot, we will endorse candidates, and members will see very few changes to how we operate. 

What is a Political Action Committee (PAC)?

The Public Disclosure Committee outlines that you become a political action committee “when you first have the expectation of receiving contributions or making expenditures in support of, or opposition to, any candidate or any ballot proposition.” Courts have clarified that supporting or opposing candidates must be one of the group’s primary purposes to qualify as a PAC.

Why did the 43rd District Democrats close their PAC?

The executive board determined that continuing to operate a PAC was not in line with the current goals of the organization and that it was too much risk considering that our only PAC activity was printing a sample ballot. It made sense to close.

Why was this decision made by the executive board alone?

This was an emergency situation, and the executive board needed to exercise its implied authority to take actions for the best interests of the organization. Given the pending litigation, executive session needed to be invoked to protect the district.

Why did the 43rd executive board send money to the Washington State Democrats?

When a PAC is closed, the funds that have been collected must be disbursed. There were few options presented to the board by our legal counsel. We felt sending the money to the State Party was most in line with the intention of our donors. 

How will members be informed of changes?

We are committed to transparency and openness to our members. We will share what we can, recognizing that other legislative districts are in the midst of pending litigation, which complicates what we are able to share in public. We promise to keep our members up to date as we work through this and we will endeavor to keep our members informed promptly. We will share updates through our website, Facebook page, and by email. We will continue to discuss this issue with our members at our January meeting and we always welcome emails to be sent to our communications team at communications@43rddems.org.

Statement on 43rd District Democrats PAC Closure

Dear 43rd District Democrats members, PCOs and supporters,

We wanted to give you an update on the campaign finance disclosure situation that we’ve shared with you at recent meetings.

As you may be aware, Glen Morgan, a conservative activist, has been busy filing complaints against progressive candidates, elected officials and county and legislative district Democratic organizations across the state regarding campaign finance disclosures — over 250 complaints at this point.

Unfortunately, the 43rd has been swept up in this wave. To understand this issue, it’s important that you have some essential knowledge about our organization and how it’s structured.

The 43rd District Democrats organization is a continuously operating entity, recognized under state law, with a membership that engages in party-building activities that advance progressive values. In addition, for much of our history, we’ve chosen to operate a PAC and register it with the state, like many other Democratic organizations have done, which allows us to spend money directly on behalf of individual candidates and ballot measures. Glen Morgan’s complaints are focused on the PAC’s activity.

After filing an initial complaint with the Attorney General, Glen Morgan recently sued the 43rd's PAC. The timing of Mr. Morgan’s lawsuit required a prompt decision by the board. After evaluating the available options, the executive board unanimously voted to shut down 43rd District Democrats PAC. As of November 27th, the 43rd District Democrats PAC is closed.

We want to walk you through what this means.

First, and most importantly, the 43rd Legislative District Democrats continues to exist as an organization. Our bylaws, board and membership will remain. Our decision only affects our PAC. We’ll continue to do many of the things we do now, including:
• Recruit, train, and engage PCOs
• Endorse candidates
• Hold meetings, discuss issues and take positions through resolutions
• Raise money and collect dues for non-candidate related expenses
• Get out the vote activities (not in support of or opposing any particular candidates)

By closing the PAC, we are getting out of the business of directly supporting candidates. That includes:
• Print candidate literature, including a sample ballot
• Contribute money to candidates (which we haven’t done for many years)
• Run a separate GOTV or persuasion campaign for candidates
• Partake in any activity or make any expense that would constitute an in-kind contribution to a candidate

The biggest practical effect for us is that around the elections, our Precinct Committee Officers will no longer be carrying the 43rd Democrats sample ballot with our endorsements. However, there will be other ways for PCOs to support candidates — we are looking at options and will keep you informed as we get closer to election season.

In closing our PAC, we paid down our debts, including the legal expenses incurred in defending the PAC against Morgan’s lawsuit, with the remainder of the money contributed to the state party. The state party will use those funds at their discretion, but they know the issues and candidates that are important to us.

Our board agrees that taking these steps now to close our PAC is the best way forward for the 43rd Democrats. In doing so, we’ll be able to continue to do many of the things we do now that make a difference, but without directly supporting individual candidates.

It's That Time of Year...

That's right, it's time for the 43rd's annual Holiday Party! This year, on Saturday, December 9, beginning at 1:00 p.m., we'll get together at Optimism Brewing on Capitol Hill (all ages). This is a no cost event, with a no-host bar, and a no-host food truck (plus plenty of great food options in the neighborhood). This is a great time to spend time with your fellow Democrats in the 43rd, and celebrate our wins of 2017!

It's November - Time for a Legislative Preview!

Now that the election is over, we are excited to gear up for 2018. As is tradition, we will be joined with our legislators, Sen. Jamie Pedersen, Speaker Frank Chopp, and Rep. Nicole Macri, during our November meeting for a preview of what to expect during session next year. Additionally, we will be considering PCO appointments, and two resolutions. Finally, the Board will give an update regarding our September Special Meeting.

We'll be meeting at University Heights Center, top floor, north room, at 7:00 p.m. on Tuesday, November 21. Doors open at 6:30 for mingling. We hope to see you then!

October Monthly Meeting Update

Our monthly meeting is coming up on October 17, 2017, and we have a packed agenda. In addition to having sample ballot packs available to folks who can't make it to Pancakes for PCOs, we'll be electing a new Secretary, appointing a representative for the King County Democrats' Legislative Action Committee and Deputy Treasurer, and considering a resolution regarding homeless encampment sweeps in Seattle.

In addition, we will hear form a panel discussing American Healthcare. The discussion over health care and insurance policy in the United States is front and center as Republicans threaten to take away insurance coverage from millions. Democrats in Congress agree that the Affordable Care Act needs reform, and are leading that fight in D.C.

There are also many who believe that the ACA should be transformed into a truly universal healthcare system. We will be joined by representatives from Indivisible North SeattleWhole Washington, and United for Single Payer. They will discuss ways we can all help not only defend against the GOP attacks on the ACA, but also steps we can take to move our health care system in a more progressive direction.

We Have Endorsements!

Folks - the 43rd District Democrats made some endorsements to finalize our list of support for this year's general election. Ours is a simple system for candidates and ballot measures on the general election ballot: one vote, and if no candidate receives 60.00%, then no candidate is endorsed (instead of having upwards of four ballots, as can be seen in some other organizations). Our endorsed candidates who made it through the primary remain endorsed, and our full slate of endorsements is as follows:

September 19, 2017 General Meeting Agenda - Endorsements, Environment, and Elections!

Our next General Membership meeting is on Tuesday, September 19, starting at 7 p.m. at University Heights Center, top floor, north side. 

First, Elected and Appointed PCOs will vote on a series of Bylaws Amendments.

We will then vote on additional endorsements, specifically in races where our endorsed candidates were unsuccessful in the primary. This includes Seattle Mayor and Port of Seattle, Position 4. Per our endorsement rules and bylaws, no other endorsements will be in order, as all other races have an endorsed candidate who is proceeding to the general election. We may also vote on ballot measures for the November election.

Finally, we will consider two resolutions: one opposing fascism, and one calling for a Coal Free Puget Sound Energy. Minutes from our July meeting can be found here. The September Agenda can also be found here.

Washington’s 43rd District Democrats need to fill three vacancies on our Executive Board at our General Meeting on Tuesday, June 20, 2017!  These roles are: Vice Chair of Communications, Vice Chair of Membership, and Co-Vice Chair of Events.

Candidates must be nominated from the floor, and seconded.  Candidates may give a 2 minute speech, and the body will vote.  All members and PCOs are eligible to vote on these roles.

Candidates may also wish to promote themselves on our Facebook Groupcreate a Candidate Page on Facebook, and/or bring a flyer, stickers, buttons, or other promotional materials to hand out to the body.

In addition to the duties described below, board members are expected to attend a monthly Executive Board Meeting on the first Tuesday of every month.

Vice Chair of Communications

Messaging is the core skill required for the role of Vice Chair of Communications.

Communications takes information from the 43rd's various officers, committees, caucuses, and produces content for our website, emails, literature, and other communication media.

Like all our Vice Chairs, the Communications Vice Chair is empowered and encouraged to create a Committee to share the duties, and to expand them as volunteer efforts allow. The Communications Vice Chair and Committee need to be able to effectively set the tone and messages to support our organizational goals.

As this is an extremely vital role with frequent ongoing duties, the Vice Chair candidate should be confident of their ability to make a serious commitment of time, effort, and availability--accountability and rapid responses are expected on social media.

The Communications Vice Chair will work with the Technology Vice Chair in creating digital content. Ideally, the Communications VC will be able to work across a variety of platforms.

These skills are not required but highly useful: HTML and web design skills; and graphic design.

 

Vice Chair of Membership

The Vice Chair of Membership is responsible for recruiting new members, most effectively empowering members, and maintaining an up to date listing of members.

Like all our Vice Chairs, the Membership Vice Chair is empowered and encouraged to create a Committee to share the duties, and to expand them as volunteer efforts allow.

The most basic task of the Membership VC is to track information on paid members in our database. This is done in conjunction with the Treasurer. The Membership Committee is also responsible for membership sign-in at meetings, in conjunction with the Programs Committee. Membership should also track volunteer interests of members and engage volunteers at all levels of involvement in the District's work.

Membership ideally should develop outreach programs to inform the community about the work of the 43rd District Democrats and attract people interested in political activism.  A further ideal goal is to create a team to welcome new members and guide them through the processes of the 43rd, such as Robert’s Rules of Order.

Required skills: Comfortable with database crunching, good people skills.

Co-Vice Chair of Events

The Events Co-Vice Chairs and Committee are responsible for the planning and production of all fund-raising events for the 43rd District Democrats, and any other events outside the scope of regular meetings.

The current opening is for a Co-Chair. (There is an excellent committee already in place!)

The Co-Chair will work with our current Co-Chair and Committee to plan events--from the fun parts of planning a party to the business of identifying locations, finding contributions for food and other needs, and soliciting sponsors for the events.

The Events committee must also work closely with the Treasurer to record contributions and ticket sales, and to track expenses and donations. This Committee also works closely with the Membership, Communications, and PCO Committees.

 

Relevant Bylaws excerpts from Washington’s 43rd District Democrats: 

7.8 All Vice Chairs

All Vice Chairs besides the First Vice Chair (a) chair and have chief responsibility for their respective Standing Committee; (b) report to the Executive Board and Membership regarding the activities of their respective Standing Committee; (c) serve on the Executive Board; and (d) perform such other duties as are assigned by the Chair.

 

8.4 Vice Chair of Membership

The Membership Committee shall (a) recruit new members of the District (b) track volunteer interests of members and engage volunteers (c) Maintain a database of members (in conjunction with the Vice Chairs for Technology and PCO recruitment) (d) track attendance at District meetings and events (e) perform such other duties as are assigned by the Chair. The Vice Chair for Membership Recruitment shall chair and have chief responsibility for the Membership Committee. The Membership Committee shall consist of Members appointed by the Vice Chair for Membership.

 

8.5 Vice Chairs of Communications and Technology

The Communications and Technology Committee shall (a) publish any notices or information required by these bylaws; (b) prepare and distribute a periodic newsletter;(c) maintain a web site; (d) maintain a member database with the Vice Chair for Recruitment; (e) conduct public relations activities; and (f) perform such other duties as are assigned by the Chair. The Vice Chair for Communications and the Vice Chair for Technology shall co-chair and have dual chief responsibility for the Communications and Technology Committee. The Communications and Technology Committee shall consist of the Secretary and Members appointed by the Vice Chairs for Communications and Technology.

 

8.6 Co-Vice Chairs of Events

The Events Committee shall (a) organize and manage at least two annual fundraising events; (b) organize and manage other non-meeting events of the 43rd District; and (c) perform such other duties as are assigned by the Chair. The Vice Chair for Events shall chair and have chief responsibility for the Events Committee. The Events Committee shall consist of the Treasurer and Members appointed by the Vice Chair for Events.

Ballots & Bubbly on Tuesday, May 16, 2017

We are not having a May meeting. Instead, on May 16 we will be holding a fun evening of mingling with the candidates while sipping bubbly at a private home in Capitol Hill. Our event has reached capacity, so sign-ups are now closed.  If you successfully submitted your RSVP, you may now purchase additional ballots to tip the scales towards your favorite candidates.

There will be a straw poll for selected competitive races! All candidates in each selected race will be listed in the straw poll.  Each person attending will receive ballots, and can purchase extra ballots!

There were several requests regarding contacting our state party representation regarding the 2017 Democratic National Committee (DNC) Chairmanship Election this weekend.

Tina Podlodowski, our State Party Chair, has published her email address to the public: tina /at/ wa-democrats.org

Additionally, Joe Pakootas, David McDonald, Sharon Mast, and Nancy Monacelli have votes in the election.  We have not yet recieved consent to publish their email addresses, but they have consented to being contacted, so you can email our chair /at/ 43rddems.org to request their email addresses or you can call the state party at (206) 883-0664 to contact them.  Mention your precinct (43-1331 for example) when you contact them, that's like a secret code revealing your depth of involvement.

For our members' ease, we have also provided a single email to reach all the DNC-level voters who have consented to be contacted by our district's membership.  Simply send your message to 2017-dnc-voters /at/ 43rddems.org and it will be delivered to all of the mentioned individuals.  Please note this single point of access will be disabled after this weekend as its purpose will have been served.
